29 CFR 1910.133(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. Turkey First Processing - On or about February 16, 17 and March 24, 2022, the employees working sanitation at Empire Kosher, were spraying down equipment with pressurized water and a variety of cleaning materials including 20045 Homogentisic Acid, 3540 2-Octyl acetate, 3131 bleach, and 5543 Triallate or combinations thereof, creating splashing and spray hazards to unprotected eyes. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

Sanitation - On or about March 24, 2022, the employees of Sanitation Solutions Plus conducting sanitation operations on the turkey kill side were not following the Empire Kosher lockout tagout program or ensure compliance with lockout tagout procedures, exposing employees to caught-in and re-energization hazards. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
