29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  The employer is failing to protect an employee that was exposed to eye and face hazards. An employee was engaged in residential roofing activities using a pneumatic nail gun without using eye protection. This was most recently documented on or about February 18th, 2022, in Bennington, Nebraska 68007.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards. This was most recently documented on or about February 18th, 2022 in Bennington, Nebraska 68007. Multiple employees were observed working on a residential structure conducting roofing operations. The exposed employees were working on the roof of the residential structure at heights over 12 feet- No fall protection was being utilized.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about February 18th, 2022, in Bennington, Nebraska 68007.  Employees were observed working at heights greater than 12ft and they have not received any form of fall protection training from their employer.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about February 18th, 2022, in Bennington, Nebraska 68007.  Employees were observed conducting roofing operations and the extension ladder that was used for access/egress to the roof did not extend at least 3ft.
