OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards of a falling tree: a. 1058 Bryant St., Rahway, NJ - Street The employer did not ensure that equipment was not placed in the drop zone when conducting tree removal activities. Employees that were working on the ground performing chipping activities associated with tree removal were exposed to the hazard of being struck by falling sections of a tree that were being cut and lowered by an arborist working from the tree. The employer did not ensure that an effective safety plan was established and enforced to restrict employees from entering the drop zone. An employee performing ground clearing was struck by a section of the tree that had just been cut by the arborist. Violation occurred on or about February 21, 2022
