OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees . On or About February 15, 2022, employees were exposed to struck by hazards as there were no permanent aisles or passageways marked where forklifts were being operated, such as, but not limited to the DESA unit.

29 CFR 1910.178(m)(1): Trucks shall not be driven up to anyone standing in front of a bench or other fixed object. On or about February 15, 2022 employee working in front of a fixed guard of the DESA East unit were exposed to struck-by hazard from a passing powered industrial truck.
