29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck On or about February 22 , 2022, at 220 Albany Turnpike, Canton, CT jobsite: The employer did not ensured that employees who operated the powered industrial truck had completed the required training program in safe operation of the vehicle. The employer did not evaluate fork truck operators at least every three years to ensure that operators had the knowledge and skills needed to operator a fork truck safely. A review of authorization cards revealed that operators were last evaluated in 2010.

29 CFR 1910.37(a)(3): Materials or equipment were placed, either permanently or temporarily, within the exit route: On or about February 22 , 2022, at 220 Albany Turnpike, Canton, CT jobsite: Employer did not keep exit routes free of items and merchandise. Exit routes were obstructed by storage of plastic bucket and merchandise boxes on either side of the emergency access route. Access to the exit was reduced.

29 CFR 1910.37(b)(2): Each exit was not clearly visible and marked by a sign reading "Exit": On or about February 22 , 2022, at 220 Albany Turnpike, Canton, CT jobsite: Employer did not provide an exit sign for a door to the outside of the store. The side-hinged exterior door at the back of the building was not provided with a sign indicating it was not intended to be used as an emergency exit. The door was locked during building occupancy with slide-bolt locks at the top and bottom of the door. The exit was not clearly visible and marked by a sign reading "Exit." This was a hazard during a fire accident in the store.
