29 CFR 1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Welder; on or about March 2, 2022 and at times prior the employer exposed the employees operating in the IQF - North area to noise at levels of 100.0% (equivalent to an 8 hour time weighted average TWA of 90.0 dBA) which is 2.0 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA). Results were calculated for a 480 minutes sampling period. The employer did not administer a continuing, effective hearing conservation program. b) Supervisor; on or about March 2, 2022 and at times prior the employer exposed the employees operating in the IQF-South area to noise at levels of 56.6% (equivalent to an 8 hour time weighted average TWA of 85.8 dBA) which is 1.1 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA). Results were calculated for a 480 minutes sampling period. The employer did not administer a continuing, effective hearing conservation program.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: a) Entire ship; on or about March 2, 2022 and at times prior the employer failed to provide employees using 3M 6300 half face respirators with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible. Employees performing fitting, welding, and cutting operations are allowed to voluntary use respirators without the information provided in Appendix D of the standard.
