OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)Slumberland, Inc., at 410 South 19th Street, Beresford, SD 57004: On or about and at times prior to February 23, 2022, the employer failed to ensure that industrial storage racking in the southeast area of the warehouse was free from damage, in that two sections of racking had bent, broken, and/or damaged stanchions and bracing while remaining in service. This condition exposed employees to struck-by and crushing hazards. Among other methods, the following is a feasible and acceptable means of abatement: Adhere to ANSI Standard MH16.2-1984 Manual of Safety Practices: A Code Of Safety Practices for the Use of Industrial and Commercial Steel Storage Racks and cantilever racks repair and/or replace racks with damaged components. Under paragraph 1.4.1 Owner Maintenance, (2)"Regularly inspect for damage. If damage is found, immediately isolate the affected area. Have a storage rack design professional evaluate the damage and unload, replace or repair if directed by the professional, any damaged columns, beams, or other structural component to restore the system to at least its original design capacity." Additionally, under paragraph 1.4.9 Rack Damage, "Upon any visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional. Before allowing the rack to be placed into service the design professional must certify that the rack system and/or the repaired components have been restored to at least their original design capacity.

29 CFR 1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a)Slumberland, Inc., at 410 South 19th Street, Beresford, SD 57004: On or about and at times prior to February 23, 2022, eyewash and shower facilities were not immediately available while servicing batteries throughout the facility. Servicing was taking place at remote locations throughout the facility by using a wheeled cart, also more than 50 feet away from quick access to a eyewash/drenching facility. This condition exposed multiple employees to severe injury by acid burns from corrosive materials. NOTE: Eyewashes should supply 0.4 gallons per minute of water for at least 15 minutes. If employees do any service to a battery beyond routine charging, then an eyewash station is required. A risk of electrolyte exposure exists in battery servicing areas, per ANSI Z358.1.

29 CFR 1910.303(g)(1):Sufficient access and working space was not provided and maintained about all electric equipment (operating at 600 volts, nominal, or less to ground) to permit ready and safe operation and maintenance of such equipment.: a) Slumberland, Inc., at 410 South 19th Street, Beresford, SD 57004: On or about and at times prior to February 23, 2022, the employer allowed two electrical disconnect switches which directly powered the battery charging station to be blocked by pallet racking and battery systems, making them inaccessible in the event of an emergency situation. This condition exposed employees potential shock and electrocution hazards related to inability to disable power during an emergency.

29 CFR 1910.37(a)(4): Safeguards designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times: a) Slumberland, Inc., at 410 South 19th Street, Beresford, SD 57004: On or about and at times prior to February 23, 2022, the employer did not ensure that multiple battery backup emergency pathway lighting systems throughout the facility were operational under battery power in the event of a power outage. This condition exposed employees, particularly those working in hours of darkness, to tripping and stuck-by hazards while attempting to egress the facility in the event egress is required during a power outage or emergency.
