29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:   a) Cozmyk Enterprises, Inc. located at 3757 Courtright Court COLUMBUS, OH 43227:  On and preceding February 24, 2022, the employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedures and the requirements of this standard were being followed. Employees were engaged in die setting and maintenance activities on machinery which included but is not limited to hydraulic press brakes and laser CNC machines.   An inspection of the hazardous energy control program had not been performed to ensure that it was being properly utilized. The following condition exposed employees to caught-in and struck-by hazards.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   a) Cozmyk Enterprises, Inc. located at 3757 Courtright Court COLUMBUS, OH 43227:  On and preceding February 24, 2022, employees were exposed to machine hazards associated with moving parts during servicing, maintenance and die setting activities on machinery which included but is not limited to hydraulic press brakes and laser CNC machines.  The employer failed to implement energy control application steps as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(S)(i)J, and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. The following condition exposed employees to caught-in and struck-by hazards.

29 CFR  1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):(   a) Cozmyk Enterprises, Inc. located at 3757 Courtright Court COLUMBUS, OH 43227:  On and preceding February 24, 2022, the employer did not ensure that a Gasparini PBS 165 hydraulic press brake was guarded to prevent employees from having any part of their body in the danger zone during operating cycle.  Employees used the press brake for various size materials  including but not limited to long aluminum angled pieces without a method in place for guarding the point of operation such as  light curtains, two-handed controls or any form of documented administrative controls thereby exposing employees to caught-in hazards.

29 CFR  1910.101(b): The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks were not in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6:   a) Cozmyk Enterprises, Inc. located at 3757 Courtright Court COLUMBUS, OH 43227:  On and preceding February 24, 2022, the employer did not ensure that compressed gas cylinders of different types and charged versus empty cylinders were separated.  Employees used various types of compressed gasses for welding and other machinery which were all stored in the same location regardless of whether they were empty or charged.  Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in CFR 1910.6: 3.3.3 states that Where gases of different types are stored at the same location, cylinders should be grouped by types of gas and the groups arranged to take into account the gases contained, e.g. flammable gases should not be stored near oxidizing gases. 3.3.4: Charged and empty cylinders should be stored separately with the storage layout so planned that cylinders comprising old stock can be removed first with a minimum handling of other cylinders.

Employees perform welding, painting, sanding and use other various chemicals  as a part of the daily processes in the industrial area.  The written hazard communication program was not implemented and maintained to address chemicals used while completing industrial processes throughout the facility.

The written hazard communication program did was not maintained to ensure that the material safety data sheets (MSDS's) were updated to safety data sheets(SDS's).
