29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Facility at 2 Jungle Rd, Leominster MA: On or about January 20, 2022, and ongoing, a written respiratory protection program addressing the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) was not established and implemented to ensure employee protection from exposure to Severe Acute Respiratory Syndrome Coronavirus-2 (SARS-CoV-2) during tasks when an N-95 respirator use was when required including, but not limited to, performing aerosol generating procedures and the use of commonly used dental equipment known to create aerosols and airborne contamination e.g. ultrasonic scaler, high-speed dental handpiece, air/water syringes, air polishing and air abrasion.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use an N-95 respirator, before the employee is fit tested or required to use the respirator in the workplace:   Facility at 2 Jungle Rd, Leominster MA: On or about January 20, 2022, and ongoing, employees required to wear respirators during tasks when respirator use was mandated including, but not limited to, performing aerosol generating procedures and the use of commonly used dental equipment known to create aerosols and airborne contamination e.g. ultrasonic scaler, high-speed dental handpiece, air/water syringes, air polishing and air abrasion, were not medically evaluated for their ability to use an N-95 respirator.
