29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. On or about February 25, 2022, the employer did not implement an effective hearing conservation program for employees working in the area where they use pneumatic nail guns to construct pallets, including audiometric testing, training on noise hazards, and regularly testing and retaining results from noise sampling in the pneumatic nail gun area. Employees were exposed to noise levels of up to 98.1 dBA. The lack of a hearing conservation program can expose employees to noise-induced hearing loss.

29 CFR 1910.1200(e)(1): The employer failed to develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about February 25, 2022 the employer failed to develop a written HAZCOM program that outlined the various hazards located in the facility, including use of the hydraulic oil in the truss system, the use of spray paint that contains acetone to mark pallets, and the changing of the propane tanks for the forklifts used onsite. This includes developing a written version of the HAZCOM training program, how to read product labels, and full documentation of the training.
