OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards when using chain saws to cut moving extruded pipe on Line 3. (a)Pipeline Plastics, LLC at 10805 US Highway 212 in Belle Fourche, SD 57717: On or about and at times prior to March 1, 2022, the employer did not ensure employees were protected from caught-in hazards associated with chainsaw kickback, pull-in and push-back. Employees utilized a Husqvarna 455 Rancher X-Torq chainsaw to cut moving extruded pipe on Line 3 due to the Battenfeld-Cincinnati CutStream PTA 400 3801166-140 pipe saw being inoperable. Cutting moving pipe on the extrusion line increased the risk of the pipe closing in on or pinching the saw blade during cutting due to compressive forces on the pipe from extrusion and cutting during lateral movement of the pipe. Pinching or closure of a workpiece on a saw blade can cause chainsaw kickback, pull-back and pull-in. This condition exposed employees to caught-in hazards. Among other methods, recognized and feasible means to reduce compressive and lateral forces exerted on the Husqvarna 455 Rancher saw chain that can cause kickback, pull-in and pushback hazards when cutting moving extruded pipe on Line 3, include: 1). Use of a chainsaw pipe clamp configured in a manner that prohibits rotational kick-back, pull-in and pushback. -and- 2). Ensure employees do not stand directly behind the saw when cutting. -or- 3). Use of the Battenfeld-Cincinnati CutStream PTA 400 3801166-140 to cut extruded pipe on Line 3.

29 CFR 1910.22(a)(3):29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice. (a)Pipeline Plastics, LLC at 10805 US Highway 212 in Belle Fourche, SD 57717: On or about and at times prior to March 1, 2022, the employer did not ensure employees were protected from slip and laceration hazards when performing work in the vicinity of the area on Line 3 where extruded pipe was manually cut with a Husqvarna 455 Rancher X-Torq chainsaw. Pipe shavings and bar oil were present on the floor exposing employees to slip hazards. Employees operating chainsaws in the area were exposed to laceration hazards that could result from a slip or loss of balance during cutting. This condition exposed employees to spill and laceration hazards.

(a)Pipeline Plastics, LLC at 10805 US Highway 212 in Belle Fourche, SD 57717: On or about and at times prior to March 1, 2022, the employer did not ensure employees were protected from trip hazards created from an exposed open trench drain from a removed production line when working in close proximity to the drain. The trench drain created a 9-inch deep by 17-inch wide opening in the floor. This exposed employees to trip hazards.

29 CFR 1910.176(g): Covers and/or guardrails were not provided to protect personnel: (a)Pipeline Plastics, LLC at 10805 US Highway 212 in Belle Fourche, SD 57717: On or about and at times prior to March 1, 2022, the employer did not ensure employees were protected from struck-by hazards in that forklifts were operated in the vicinity of an open drain trench approximately 9 inches deep and 17 inches wide. The drain trench was not covered or barricaded to prevent forklift access. This condition exposed employees operating or in the vicinity of forklift operation to struck-by hazards.
