29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  Employees were exposed to noise hazards in the following instances:  1)  DOOR DEPARTMENT: On March 2, 2022, employee was exposed to noise hazards. Employee operating Rover K CNC machine was exposed to noise at a dose in excess of the 100% dose Permissible Exposure Limit (PEL), where noise sampling performed for 385 minutes indicated that the employee was exposed to continuous noise level at 122% noise dose which is equivalent to approximately 91.4 dBA, 8-hour time-weighted average.   2) DOOR DEPARTMENT: On March 2, 2022, employee was exposed to noise hazards. Employee building kitchen cabinets using shaper, router and sanders was exposed to noise at a dose in excess of the 100% dose Permissible Exposure Limit (PEL), where noise sampling performed for 377 minutes indicated that the employee was exposed to continuous noise level at 104% noise dose which is equivalent to approximately 90.3 dBA, 8-hour time-weighted average.  3) HANGOUT AREA:  On March 2, 2022, employee was exposed to noise hazards. Employee building kitchen cabinets using pneumatic nail gun was exposed to continuous noise level at 59.5% which is equivalent to 86.2 dBA, 8-hour time-weighted average where noise sampling was performed for 370 minutes.     a)  The employer failed to administer a hearing conservation program. b)  The employer failed to implement a noise monitoring program to identify employees for inclusion in the hearing conservation program. c)  The employer failed to establish an audiometric testing program. d)  The employer failed to ensure that exposed employees used hearing protection. e)  The employer failed to institute a training program and ensure employees participate in the program.
