29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a)Perfect Framing Structure LLC at 8610 West 41st Street, Sioux Falls, SD 57108: On or about and at times prior to March 1, 2022, the exposing employer did not ensure employees were protected from fall hazards by use of an appropriate fall protection system when performing steel trim installation on the parapet of a flat pitched roof system. Multiple employees were engaged in trim installation, at multiple locations on the edge of the roof system without the use of a Personal Fall Arrest System or other fall protection system. This condition exposed six employees to fall hazards greater than six feet.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)Perfect Framing Structure LLC at 8610 West 41st Street, Sioux Falls, SD 57108: On or about and at times prior to March 1, 2022, the exposing employer did not ensure that employees were trained in the use of fall protection systems or hazards of working from heights prior to conducting construction activities from heights of 40 feet on a commercial low sloped roof. This condition exposed six employees to fall hazards greater than six feet.

29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Perfect Framing Structure LLC at 8610 West 41st Street, Sioux Falls, SD 57108: On or about and at times prior to March 1, 2022, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees were conducting parapet finishing activities on a 1.5 /12 pitch roof, directly exposed to the edge of the roof system, without the use of fall protection equipment. This condition exposed employees to fall hazards of up to 30 feet to the ground below. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
