29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i)(A)-(C):  Modern Fabrication Co., LLC, working on-site at Continental Tire The Americas, LLC, 11525 North Illinois Highway 142, Mt Vernon, Illinois 62864:  On or about February 24, 2022 and times prior, an employee performing cleaning on rubber racks adjacent to Line 6 was exposed to a fall hazard of approximately 4 feet 8 inches while working on the first level of an unguarded rack with a fall protection harness on but not tethered.

29 CFR  1910.30(a)(1):  Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart:  Modern Fabrication Co., LLC, working on-site at Continental Tire The Americas, LLC, 11525 North Illinois Highway 142, Mt Vernon, Illinois 62864:  On or about February 24, 2022 and times prior, an employee performing cleaning on rubber racks adjacent to Line 6 was exposed to a fall hazard approximately 4 feet 8 inches high while working on the first level of an unguarded rack with a fall protection harness on but not tethered.  Training documents for employee were requested but not received.
