29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  On or about March 2, 2022, the employer provided employees with a1044C-54 rough terrain forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.250(b)(7): Masonry blocks were stacked higher than 6 feet, and the stack(s) were not tapered back one half block per tier above the 6 foot level.  a) On or about March 2, 2022, employees at a new construction site were exposed to struck by hazards in the staging area where masonry blocks were stacked approximatively 12 feet and not tapered back.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
