29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  (a) EMIT Technologies, Inc. at 2985 1st Avenue, Greeley, CO 80631: On and before March 3, 2022 the employer did not identify and evaluate the respiratory hazards in the workplace, including a reasonable estimate of employee exposures to respiratory hazards during the spraying of hazards chemicals, which include AUE-370 DTM Polyurethane, Macropoxy 646, and SB-02 Fast Ketone Urethane Reducer. This condition exposed employees to health hazards associated with exposure to chemicals that irritate the lungs and eyes, as well as have the potential to cause damage to organs through prolonged or repeated exposure

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a) EMIT Technologies, Inc. at 2985 1st Avenue, Greeley, CO 80631: On or before March 3, 2022 the employer did not ensure all forklift operators were trained in operation of power industrial trucks, in that employees were not trained on the operation of the Komatsu Forklift, Model: FG25T-12, and the Combilift Ltd., Model: CB6000. This condition exposed employees to the hazard of struck by hazards.

29 CFR  1910.179(j)(2)(iv): Monthly inspections of hoist chains, with a certification record which includes the date of inspection, the signature of the person who performed the inspection and an identifier of the chain which was inspected, were not performed:  (a) EMIT Technologies, Inc. at 2985 1st Avenue, Greeley, CO 80631: On and before March 3, 2022, the employer did not provide monthly inspection records for multiple 3/8 inch steel chains used in conjunction with 5-ton and 10-ton KONECRANES bridge cranes. Employees used the equipment to hoist and move materials throughout the facility. This condition exposed employees to struck by hazards.
