29 CFR  1903.19(c)(1):  The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  (a) The employer failed to certify that Citation 1, Item 1, issued on 05/11/2022 with an abatement date of 06/07/22 had been abated.  (b)The employer failed to certify that Citation 1, Item 2, issued on 05/11/2022 with an abatement date of 06/07/22 had been abated.

29 CFR  1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  The employer failed to protect employees from fall hazards associated with commercial roofing in proximity to skylights.  This was most recently documented on March 2, 2022, at 3730 N 56th St, in Lincoln, Nebraska when an employee fell through an unprotected skylight opening at a commercial building site.  The employee was incorrectly using a harness and lanyard system that was set too long for the specific application.

29 CFR  1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used:  The employer failed to protect employees from fall hazards while working on the roof of a commercial structure with skylight openings. On March 2, 2022, employees of Rubens Roofing were working on the roof of a commercial building that had unprotected skylight openings.  The employees were using harnesses attached to ropes that were fastened to anchor points on the roof as a personal fall arrest system.  The employees had not received training in the effective  use of the fall arrest system.
