29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about 3/09/2022, at the mill, employees had individual noise exposures that exceeded 85 decibels for an 8-hour Time-Weighted-Average (TWA), measured on the A scale in the following instances: a) saw operator/post sorter with an 8-hour TWA of 98.2 dBA; b) equipment operator/bundler with an 8-hour TWA of 90.6 dBA; c) saw operator/post sorter with an 8-hour TWA of 95.8 dBA; d) post peeling operator with an 8-hour TWA of 96.7 dBA; e) post sorter with an 8-hour TWA of 90.7 dBA; f) saw operator/post sorter with an 8-hour TWA of 96.0 dBA g) front deck hand with an 8-hour TWA of 90.3 dBA; and h) pole peeler operator with an 8-hour TWA of 97.4 dBA.
