29 CFR 1926.451(b)(1):   Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   a)  Worksite, Interior - Employee was working on the third tier of a fabricated frame scaffold approximately 18 ft above the ground.  The employee was working on a platform that was not fully planked; on or about 12/13/21.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access. Employees did not use portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface.    a)  Worksite, 26 Forrest Crossing - Employees were spackling sheetrock while working from a fabricated frame scaffold.  The employees were climbing the crossbraces to gain access to the scaffold; on or about 12/13/2021.    Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)  Worksite, 26 Forrest Crossing - Employee was taping sheetrock in a multistory single family home while working on the third  tier of a fabricated frame scaffold.  The employee was not protected from falling approximately 18ft to the ground below; on or about 12/13/21.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(f)(3):Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a) On December 13, 2021 at worksite, the brakes of the caster wheels were not inspected to immobilize the scaffold when it was being used.

29 CFR  1926.452(w)(2):Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold is used in a stationary manner.  a) On or about December 13, 2021, employee  spackling sheetrock from  scaffold with defective casters fell 18 feet to the ground when he leaned against the wall causing the scaffold to roll away from wall causing him to fall  to the ground below.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) On or about December 13, 2022 , an employee of Builders HQ fell 18 feet from a scaffold. The injuries sustained required hospitalization. The OSHA Area Office was not notified of the hospitalization.
