29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: a) 200 Passaic Ave, Kearny, NJ The employer did not implement the engineering controls identified on Table 1 for employees directed to demolish concrete in footing excavations approximately 3 feet by 3 feet by 3 feet deep, with a Pro Drill B87C pneumatic jackhammer. The employees were exposed to the hazard of airborne respirable crystalline silica. Violation occurred on or about March 8, 2022

The employees were exposed to the hazard of airborne respirable crystalline silica. The employer did not assess the workers exposure to Silica when the employer was not following Table 1. Violation occurred on or about March 8, 2022
