OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed by hazards:  (a) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, employees were exposed to struck-by and crushing hazards in that commercial pallet racking located on the west interior side of the raw materials storage building had two damaged legs and was being used to store merchandise. This condition exposed employees to struck-by and crushing hazards.  (b) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, employees were exposed to struck-by and crushing hazards in that commercial pallet racking located on the west side of the raw materials storage building had two bent crossmember support beams and was being used to store merchandise. This condition exposed employees to struck-by and crushing hazards.  (c)  Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022,  employees were exposed to struck-by and crushing hazards in that commercial pallet racking located inside the assembly building had one damaged leg and was being used to store merchandise. This condition exposed employees to struck-by and crushing hazards.   Abatement Note:  Among other methods, one feasible and acceptable abatement methods to correct this hazard are to follow American National Standards Institute (ANSI) and Rack Manufacturers Institute (RMI)-ANSI-RMI MH 16:1-2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks."   Under paragraph 1.4.1 Owner Maintenance, (2)"Regularly inspect for damage. If damage is found, immediately isolate the affected area. Have a storage rack design professional evaluate the damage and unload, replace or repair if directed by the professional, any damaged columns, beams, or other structural component to restore the system to at least its original design capacity." Additionally, under paragraph 1.4.9 Rack Damage, "Upon any visible damage, the pertinent portions of the rack shall be immediately isolated by the user until the damaged portion is evaluated by a storage rack design professional. Before allowing the rack to be placed into service the design professional must certify that the rack system and/or the repaired components have been restored to at least their original design capacity.

29 CFR  1910.37(b)(1):The exit route was not adequately lit:  a) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer failed to ensure that emergency lighting over the north wall emergency exit in the raw materials storage building was functional in the event of a power outage or subsequent emergency in that lighting did not function on battery power.  This condition exposed employees to injuries associated with trips and falls while attempting emergency egress through a dark warehouse.  b) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer failed to ensure that emergency lighting over the east wall emergency exit in the raw materials storage building was functional in the event of a power outage or subsequent emergency in that lighting did not function on battery power. 29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer did not establish a program consisting of specific energy control procedures to control hazardous energy exposure on multiple energy source pieces of equipment including, the North Tech Industrial Machine - Cort Machine, Black Laminate Machine, Voorwood Shaper/Sander, Homag Edge Bander and Dado Machine, Sawstop Table Saws, Fletcher Machine Inc. - Foiling and Profiling Machine, Gabbiani Machine - Automated Saw among other machines.  This condition exposed multiple employees to crushing, amputation shock and air embolisms while maintaining equipment.

29 CFR  1910.303(b)(7)(i):Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment:  (a) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer did not ensure that electrical equipment was effectively closed, in that an electrical outlet box within the assembly area was missing a knockout at Station 12.  This condition exposed employees to electrical and fire hazards associated with exposed wiring on the electrical boxes.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:   (a) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer failed to ensure that hazardous chemicals were properly labeled within the facility.  Varicure-Federal Oak stain, product ID 431-17249, was stored in an unmarked container in one metal gallon container immediately outside of the staining booth. This condition exposed employees to injuries due to improper use of chemicals.  (b) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, the employer failed to ensure that hazardous chemicals were properly labeled within the facility.  Varicure-Federal Oak stain, product ID 431-17249, was stored in an unmarked container in one plastic five gallon container inside the staining booth. This condition exposed employees to injuries due to improper use of chemicals.  (c) Perdue, Inc. at 2415 Creek Drive, Rapid City, SD 57703: On or about and at times prior to March 7, 2022, employees were exposed to chemical hazards in that a hazardous chemical in the workplace was not labeled. Varicure-Federal Oak stain, product ID 431-17249, was stored in an unmarked metal container in a yellow flammable cabinet adjacent to the north exit door in the staining area. This condition exposed employees to injuries due to improper use of chemicals.
