29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about March 9, 2022, the employer failed to ensure that operators of the Crown forklift had received training that complied with 1910.147(l)(2)(ii) that contained formal instruction, practical hands-on training and evaluation of the operator's performance on this same piece of equipment used in daily operations. Use of forklift operators without compliant training increases risk of accident and injury related to employees being struck by the forklift while in operation.

29 CFR 1910.132(d)(1):The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) On or about March 9, 2022, the employer failed to perform the personal protective equipment hazard assessment as required by this part to determine if hazards are present that necessitate use of PPE. The employer had not performed a hazard assessment at the 21st Street or Norton Avenue locations. Employees utilize glue sticks and bottle DuraPro glue on a daily basis in the assembly of cardboard retails displays.

29 CFR 1910.1200(g)(8):The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s): a. On or about March 9, 2022, the employer failed to maintain copies of safety data sheets for each hazardous chemical used in the workplace, such as glues (DuraPro G-2459 US and Hot Melt Technologies HM-6430). Glues used in the workplace contain hazardous ingredients that include pertoleum distillates and ethylene glycol diacetate.
