29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. On or about March 10, 2022, and at times prior thereto, an employee performing carbon fiber cutting operations was required to wear a full-face respirator without having a medical evaluation, exposing the employee to the hazard of exacerbating a cardiac or pulmonary condition, increasing physiological burden, and various respiratory issues.
