29 CFR  1910.22(a)(3): The employer must ensure walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice.   On or about March 9, 2022, at the facility located at 1105 Jackson Street, Merrill, Wisconsin, the employer failed to provide a safe walking-working surface due to large cracks and sunken portions of concrete, which created trip and fall hazards.

29 CFR 1910.36(g)(2): An exit access must be at least 28 inches (71.1 cm) wide at all points. Where there is only one exit access leading to an exit or exit discharge, the width of the exit and exit discharge must be at least equal to the width of the exit access.  On or about March 9, 2022, at the facility located at 1025 East Main Street, Merrill, Wisconsin, the employer failed to ensure employees had at least 28 inches for emergency egress from the basement area.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  All provisions of 29 CFR 1910.1200(e) through (h) must be contained in a written hazard communication program. Key provision includes but are not limited to the following: 1) List of hazards chemicals 2) Complete collection of SDS 3) Labeling of containers 4) Employee information and training  On or about March 9, 2022, at the facilities located at 1022 East Main Street, 1025 East Main Street, and 1105 West Jackson Street, in Merrill, Wisconsin; the employer did not implement and maintain a written hazard communication program when employees worked with hazardous chemicals such as, but not limited to Waterproofer in Fast Dry.
