29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment: a. On or about March 16, 2022, at the establishment located at N6480 Riverview Road Porterfield, Wisconsin; the employer did not administer a hearing conservation program to protect an employee working in the Stake Shed near the Keystone Pointer. The employee was exposed to noise at 237.8% (noise dose) of the allowable noise dose of 50% during a sample period of 482 minutes during one shift. 237.8% is equivalent to an 8-hour TWA sound level of 96.3 dBA. b. On or about March 16, 2022, at the establishment located at N6480 Riverview Road Porterfield, Wisconsin; the employer did not administer a hearing conservation program to protect an employee operating the head saw in the sawmill. The employee was exposed to noise at 148.7% (noise dose) of the allowable noise dose of 50% during a sample period of 483 minutes during one shift. 148.7% is equivalent to an 8-hour TWA sound level of 92.9 dBA. All provisions of 29 CFR 1910.95(c) through (n) must be covered in a hearing conservation program. The employee, working in the Stake Shed near the Keystone Pointer, was exposed to noise at 237.8% (noise dose) of the allowable noise dose of 50% during a sample period of 482 minutes during one shift. 237.8% is equivalent to an 8-hour TWA sound level of 96.3 dBA. b. On or about March 16, 2022, at the establishment located at N6480 Riverview Road Porterfield, Wisconsin; the employer had not established an audiometric testing program for an employee who was exposed to an 8-hour TWA greater than 85 decibels. 29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 1910.147(d)(1)-(6): On or about March 3, 2022, at the establishment located at N6480 Riverview Road Porterfield, Wisconsin; employees were exposed to machine hazards associated with moving parts when they engaged in unjamming activities on the on the stringer notcher. The employer did not ensure that energy control application steps to control the electrical energy sources were implemented prior to allowing an employee to remove a jam while the stringer notcher was running. The machine was not shut down or turned off prior to engaging in this servicing and maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.213(g)(1):Each swing cutoff saw shall be provided with a hood that will completely enclose the upper half of the saw, the arbor end, and the point of operation at all positions of the saw. The hood shall be constructed in such a manner and of such material that it will protect the operator from flying splinters and broken saw teeth. Its hood shall be so designed that it will automatically cover the lower portion of the blade, so that when the saw is returned to the back of the table the hood will rise on top of the fence, and when the saw is moved forward the hood will drop on top of and remain in contact with the table or material being cut. On or about March 10, 2022, at the establishment located at N6480 Riverview Road Porterfield, Wisconsin; the employer did not ensure that the swing saw had a hood that covered the arbor or was so designed that it will automatically cover the lower portion of the blade when the saw is in use.
