29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:       (a)	On and before March 8, 2022, the employer was utilizing job made forklift tang extensions with the Hyster 80 forklift. The manufacturer's approval to use the attachment with the lift was not obtained. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.   (a)	On and before March 8, 2022, the employer did not ensure all forklift operators were trained in the operation of powered industrial trucks and that the operator's training consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace. This condition exposed employees to struck-by hazards when employees operated forklifts without having been adequately trained and evaluated. This condition exposed employees to struck-by and crushing hazards.

29 CFR 1910.178(l)(6):  The employer did not certify that each operator has been trained and evaluated in the safe operation of the forklifts in the workplace:  (a)	On and before March 8, 2022, the employer did not certify that the forklift operator had been trained and evaluated as required by 29 CFR 1910.178(l) in the topics as outlined in 29 CFR 1910.178(l)(3). This condition exposed employees to struck-by hazards when employees operated forklifts without having been adequately trained and evaluated.  Abatement Note:  The certification shall include:        (1)  The name of the operator;       (2)  The date of the training;       (3)  The date of the evaluation; and,       (4)  The identity of the person(s) performing the training and evaluation.

29 CFR 1910.147(c)(4)(i):  Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  (a)	On and before March 8, 2022, the employer did not ensure that procedures were developed, documented and utilized for the control of energy when employees were performing repair and maintenance activities in that the employer's instructions were not specific enough to prevent exposing employees to accidental re-energization of the equipment being worked on. This condition exposed employees to crushing and amputation hazards associated with equipment such as, but not limited to trash truck repair and maintenance work.
