OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust fire hazards associated with the use of an indoor enclosureless dust collector for equipment associated with frequent production of sparks:  (a)   On or about March 11, 2022:  A Baileigh Cyclone dust collector was used to collect combustible wood dust from upstream woodworking equipment including a Grizzly model GO919 twin head duel blade cutting system with a hydraulically controlled  automatic feed system.  The use of the indoor cyclone dust collector on equipment likely to produce sparks/embers during use, such as the saw, exposed employees to combustible dust fire hazards (i.e. exposure to flame and/or hazardous byproducts of fire including smoke and toxic gases).  (b) On or about March 11, 2022:  A Choice Dust Collector, enclosure less dust collector was used to collect combustible wood dust from upstream woodworking equipment including a Grizzly G0503 12 inch re-saw band saw having an automatic feed system.  The use of the indoor enclosure less collector on equipment likely to produce sparks/embers during use, such as cutting through nails, exposed employees to combustible dust fire hazards (i.e. exposure to flame and/or hazardous byproducts of fire including smoke and toxic gases).  (c) On or about March 11, 2022:  A Choice Dust Collector, enclosure less dust collector was used to collect combustible wood dust from upstream woodworking equipment including a High Point 12 inch re-saw band saw having an automatic feed system.  The use of the indoor enclosure less collector on equipment likely to produce sparks/embers during use, such as cutting through nails, exposed employees to combustible dust fire hazards (i.e. exposure to flame and/or hazardous byproducts of fire including smoke and toxic gases).

29 CFR 1910.22(a)(1):  All places of employment, passageways, storerooms, service rooms, and walking-working surfaces were not kept in a clean, orderly, and sanitary condition.  (a) On or about March 11, 2022, in the block cutting area of facility,  wood dust accumulation at and around the DeWalt 14" mitre saws, and on adjacent storage racking horizontal surfaces  was not regularly cleaned up, exposing employees to fire and combustion hazards, and inhalation of toxic chemical hazards. Exterior surfaces of the saw, and the work areas horizontal surfaces around the saw were covered with an adequate layer of wood dust to facilitate ignition when sparks are created as a result of metal on metal contact that occurs when the saw cuts through metal such as nails and staples, or can also result from the heated blade motor that was covered in wood dust.  (b) On or about March 11, 2022, in the pallet dismantling area of facility,  wood dust accumulation at and around the Wood -Mizer pallet hawg PD200 Pallet dismantler band saws, and on adjacent storage racking horizontal surfaces  was not regularly cleaned up, exposing employees to fire and combustion hazards, and inhalation of toxic chemical hazards. Exterior surfaces of the saw, and the work areas horizontal surfaces around the saw were covered with an adequate layer of wood dust to facilitate ignition when sparks are created as a result of metal on metal contact that occurs when the saw cuts through metal such as nails and staples, or can also result from the heated blade motor that was covered in wood dust.

29 CFR  1910.213(g)(1): Swing  cutoff saw(s) were not provided with an automatically adjusting hood that completely enclosed the upper half of the saw, the arbor end, and the point of operation at all positions of the saw:  Its hood was not designed in a manner  that as to automatically cover the lower portion of the blade, so that when the saw was returned to the back of the table the hood will rise on top of the fence, and when the saw was moved forward the hood will drop on top of and remain in contact with the material being cut.  (a)  14 inch CTD Cut-Off Saw - Located in the middle of production area: On or about March 11, 2022, the automatic adjusting hood guard  located on each of the two independent  operating heads  of the saw did not operate in a manner that would fully cover the blade and protect employees working at and around the exposed saw blades from cuts, abrasions, and amputation hazard.

29 CFR  1910.213(r)(4): Suitable guard(s) were not provided to reduce to a minimum the hazard due to the point of operation of a Bandsaw dismantler wood cutting machine:   (a) On or about March 11, 2022, at the 1st pallet dismantler bandsaw (Wood-Mizer USA Pallet Hawg PD 200),  guarding was not provided to protect employees at, or around the machine point of operation from  hazards associated with  exposure to the unguarded and  unused  portions of the exposed bandsaw blade. This exposed employees to cuts and amputation hazard.   (b) On or about March 11,2022, at the 2nd pallet dismantler bandsaw (Wood-Mizer USA Pallet Hawg PD 200),  guarding was not provided to protect employees at, or around the machine point of operation from  hazards associated with  exposure to the unguarded and  unused portions of the exposed bandsaw blade. This exposed employees to cuts and amputation hazard.
