29 CFR 1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On March 8, 2022, located on a commercial roof, an employee, while performing clean-up work, removed a rooftop unit cover and fell through the roof opening landing on the concrete surface below. The employer failed to instruct the employee to recognize and to avoid the hazards of removing the rooftop unit cover.

29 CFR 1926.501(b)(4)(i):Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. (a) On March 8, 2022, located on a commercial roof, an employee was exposed to a fall hazard by removing a rooftop cover and not adequately utilizing a fall protection system. The employee fell through a roof opening landing 12 feet onto the concrete surface below.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) The employer failed to report a work-related inpatient hospitalization accident to OSHA within 24 business hours of learning of an employee who fell through a commercial roof opening while performing clean-up on March 8, 2022, at 2411 East Main Street, Springfield, OH 45503.
