On or about February 7, 2022, and in times prior thereto, the employer did not ensure that each affected employee use appropriate face protection (face shield) necessary to protect maintenance workers from face hazards from flying particles during cooker reel descaling.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment had been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment. (a) Seneca Foods Corporation, 100 Gambee Road, Geneva, NY. On or about February 7, 2022, and in times prior thereto, the employer did not prepare a certification of hazard assessment which prescribes the personal protective equipment necessary to protect the maintenance workers from the identified hazards of cooker reel descaling. Seneca Foods Corporation was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.132(d)(2), which was contained in OSHA inspection number 1275913 citation number 1 , item number 1 and was affirmed as a final order on January 22, 2018, with respect to a workplace located at 30 Keystone Drive, Lebanon, PA, 17042.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily are medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks). a) Seneca Foods Corporation, 100 Gambee Road, Geneva, NY. On or about February 7, 2022, and in times prior thereto, the employer did not establish and implement elements of a written respiratory protection program necessary to ensure that employees using respirators voluntarily are medically able to use that respirator. The employer provided half face elastomeric respirators to employees, including but not limited to: maintenance personal, voluntarily.
