29 CFR  1910.212(a)(1):  One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about March 16, 2022, at the facility located at 900 West Drexel in Oak Creek,  Wisconsin, machinery/equipment were not properly guarded to prevent employees from accessing the danger zones, in that:  (a) The shop made hydraulic press operated by a single handle did not have guarding implemented to prevent the operator or other employees from reaching the point of operation, and;  (c) The Andrychow lathe was missing the chuck guard to protect the operator from flying chips and to prevent contact with the rotating chuck during operation.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about March 16, 2022, employees engaged in metal parts manufacturing were exposed to hazardous materials, such as but not limited to, paint thinner, degreasers, and lubricants. The employer had not developed and implemented a program which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with Globally Harmonized System (29 CFR 191200(a)(1)).  The written program must contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills; 3. The hazards of the materials contained in piping that is not labeled, and; 4. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
