29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented, and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: (a) Dairy Resources of the West, LLC DBA Dairy Resources at 17868 County Road 15, Platteville, CO 80651: On or before March 9, 2022, machine specific, step-by-step procedures were not developed, documented, and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section. An employee was changing a filter on an energized travelling receiver when his leg became caught between the receiver and an elevated concrete platform. The employee suffered a broken leg. This condition exposed employees to struck-by and caught in-between hazards. caught between hazards. Abatement Note: Procedures shall be developed, documented, and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section. The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following: 1) A specific statement of the intended use of the procedures; 2) Specific procedural steps for shutting down, isolating, blocking, and securing machines or equipment to control hazardous energy; 3) Specific procedural steps for the placement, removal, and transfer of lockout devices or tagout devices and the responsibility for them; and 4) Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees: (a) Dairy Resources of the West, LLC DBA Dairy Resources at 17868 County Road 15, Platteville, CO 80651: On or before March 9, 2022, the employer did not provide adequate training to ensure that employees acquired the knowledge and skills necessary for the safe application, usage and removal of energy control devices including, but not limited to a travelling receiver. This condition exposed employees to struck-by and caught in-between hazards. Abatement Note: The training shall include the following: 1) Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control. 2) Each affected employee shall be instructed in the purpose and use of the energy control procedure. 3) All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or re-energize machines or equipment which are locked out or tagged out.

(a) Dairy Resources of the West, LLC DBA Dairy Resources, 17868 County Road 15, Platteville, CO 80651: On or before March 9, 2022 the employer did not report the in-patient hospitalization of an employee that broke his leg while performing maintenance of a rotary parlor. The employee was admitted to the hospital on Marc 7, 2022, and the employer did not report the hospitalization to OSHA until March 9, 2022.
