29 CFR 1926.452(k)(4): Ladders used to support ladder jacks were not placed, fastened, or equipped with devices to prevent slipping: (a)ABC Seamless Siding of Sioux Falls, Inc., at 618 East Pipestone Street, Flandreau, SD 57028: on or about and at times prior to March 16, 2022, the employer failed to ensure a ladder that was supporting one side of a ladder jack system was secured from tipping while being erected on a sloped surface. This condition resulted in failure of the ladder jack system causing one employee to fall more than nine feet to the ground.

29 CFR 1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a)ABC Seamless Siding of Sioux Falls, Inc., at 618 East Pipestone Street, Flandreau, SD 57028: on or about and at times prior to March 16, 2022, the employer did not ensure employees working from a ladder jack scaffold system was trained in the procedures to control and minimize scaffold-related hazards prior to beginning work.

29 CFR 1926.454(b):The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work: (a)ABC Seamless Siding of Sioux Falls, Inc., at 618 East Pipestone Street, Flandreau, SD 57028: on or about and at times prior to March 16, 2022, the employer did not ensure that employees were trained to erect, operate, inspect and maintain a ladder jack scaffold system that was being used regularly on the jobsite in that the ladder jack system failed due to improper erection and inspection which resulted in collapse of the scaffold system leaving one employee injured when he fell to the ground below.

29 CFR 1926.95(d)(1):Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees. (a)ABC Seamless Siding of Sioux Falls, Inc., at 618 East Pipestone Street, Flandreau, SD 57028: on or about and at times prior to March 16, 2022, the employer did not provide or pay for safety glasses and gloves that were required for demolition work on a daily basis. Employees were purchasing their own safety glasses and gloves for demolition work and were not being reimbursed by the employer.
