29 CFR  1926.451(a)(1): Scaffold(s) and scaffold(s) component(s) were not capable of supporting, without failure, its own weight and at least four times the maximum intended load applied or transmitted to it:  a) Sea Glass Apartments at 32815 Azure Avenue Rehoboth Beach, DE 19971: On or about March 16, 2022, the employer failed to ensure that a piece of wood being used as a scaffold would be able to support its own weight and at least four times the maximum intended load. The employer allowed for an employee to grab a piece of wood provided for framing and place it onto two mid-rails that were not rated.

29 CFR  1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:  a) Sea Glass Apartments at 32815 Azure Avenue Rehoboth Beach, DE 19971: On or about March 16, 2022, the employer failed to ensure employees using a board as a scaffold to work on the side of a building was at least 18 inches in width. The board being used was a 2x4 piece of lumber for the framing of the building.

29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards:  a) Sea Glass Apartments at 32815 Azure Avenue Rehoboth Beach, DE 19971 - On or about March 16, 2022, the employer did not train each employee exposed to a fall hazard to properly recognize and minimize fall hazards.  Abatement Note: The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards.  Each employee must be trained by a competent person in the following: 1. The nature of fall hazards in the work area; 2. The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; 3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4. The role of each employee in the safety monitoring system when this system is used; 5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; 7. The role of employees in fall protection plans; 8. The standards contained in this subpart. The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.
