29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a) Asmussen Construction, L.L.C., at the area of 300 US Highway 81, Arlington, SD 57212: On or about and at times prior to March 15, 2022, the employer did not ensure that employees were protected from falls while conducting re-roofing operations on a commercial property. This condition exposed employees to fall hazards from 8 feet to 16 feet to the ground.

29 CFR 1926.1053(b)(16): Portable ladder(s) with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not taken out of service until repaired: (a) Asmussen Construction, L.L.C., at the area of 300 US Highway 81, Arlington, SD 57212: On or about and at times prior to March 15, 2022, the employer did not ensure that an unmarked, aluminum non-self supporting ladder was removed from service due to damaged side rail support at the base of the ladder. This condition exposed two employees to fall hazards associated with egressing an elevated working surface using a structurally deficient ladder.
