29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On or about March 15, 2022, and at times prior thereto, the employer did not ensure employees/workers were trained, evaluated  and competent to operate a powered industrial truck, exposing them to struck-by, roll-over and ejection hazards.

29 CFR  1910.253(b)(4)(i): Oxygen cylinders shall not be stored near highly combustible material, especially oil and grease; or near reserve stocks of carbide and acetylene or other fuel-gas cylinders, or near any other substance likely to cause or accelerate fire; or in an acetylene generator compartment.  On or about March 15, 2022, at at times prior thereto, the employer did not ensure oxygen and acetylene cylinders in the shop area were stored and secured in a partition separating the cylinders which exposed workers/employees to combustible and fire hazards.

29 CFR  1910.254(d)(9)(i): The operator did not report any equipment defect or safety hazard to his supervisor and the use of the equipment will be discontinued until its safety has been assured. Repairs was not made by qualified personnel.  On or about March 15, 2022 and at times prior thereto,  the employer did not ensure the Millermatic 350P Aluminum welding machine was taken out of service when wires were pulled away and were exposed on the welder.

29 CFR  1910.303(b)(2):Installation and use. Listed or labeled equipment was not installed and used in accordance with any instructions included in the listing or labeling.  On or about March 15, 2022, and at times prior thereto, employees were not protected from electrical shock hazards where metal electrical gang/ junction boxes designed for mounting were used as;  a) a portable extension cord  to operate the the pipe bending machine,  b) a portable extension cord to operate the miller welders in the shop, and  c) a portable extension cord on job sites to work on outside projects for the company.

29 CFR  1910.305(g)(2)(iii):Flexible cords and cables was not connected to devices and fittings so that strain relief is provided that will prevent pull from being directly transmitted to joints or terminal screws.   On or about March 15, 2022, and at times prior thereto, employees were not protected from electrical shock and fire hazards where electrical cord outer sheathing was pulled away exposing conductors and not having fittings or devices that would prevent direct pull and abrasion to the wires;  a)  in the shop welding area, the Millermatic 350p plug/cable was not equipped with strain relief,  b)  in the shop next to the welding area the pedal wiring on pipe bender  was not equipped with strain relief,   c)  the wiring going into the pipe bender from the foot pedal was not equipped with strain relief, and   d) the extension cord used for outside projects was not equipped with strain relief.

29 CFR  1910.334(a)(2)(i):Portable cord and plug connected equipment and flexible cord sets (extension cords) was not visually inspected before use on any shift for external defects (such as loose parts, deformed and missing pins, or damage to outer jacket or insulation) and for evidence of possible internal damage (such as pinched or crushed outer jacket). Cord and plug connected equipment and flexible cord sets (extension cords) which remain connected once they are put in place and are not exposed to damage need not be visually inspected until they are relocated.  On or about March 15, 2022, and at times prior thereto, the employer did not ensure each portable cord and plug connected equipment was visually inspected before use on any shift for external defects.
