29 CFR  1910.243(a)(1)(i):Portable power driven circular saw(s) having a blade diameter greater than two inches were not equipped with guard(s) below the base plate or shoe which automatically and instantly returned to the covering position when the tool was withdrawn from the work:  Site- On or about March 11, 2022 an employee sustained a severe laceration where the Makita 5007F circular saw provided by the employer to cut scrap wood did not have a blade guard that automatically and instantly returned to the covering position when the tool was withdrawn from cutting. The employee withdrew the circular saw from a cut and when placing the saw on the ground they contacted their leg with the unguarded blade where the blade guard did not automatically and instantly retract to the covering position.
