On or before March 17, 2022, the employer did not ensure the walking/working surfaces of the shop were kept in a clean, orderly condition. Employees worked in the shop where metal bands were strewn across the floor where employees walked, thereby exposing employees to fall and other hazards.

On or before March 17, 2022, the employer did not ensure employees were competent to operate powered industrial trucks through the successful completion of training and evaluations. Employees operated forklifts without any formal instruction or evaluations, thereby exposing employees to struck-by hazards.

29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a. On or before March 17, 2022, the employer did not ensure powered industrial vehicles were examined daily. Employees operated powered industrial vehicles without having conducted a daily inspection and defects that affected safety were not immediately reported and corrected, thereby exposing employees to struck-by hazards.
