29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) Rusin Concrete Construction, 2475 Waynoka Rd, Colorado Springs, CO 80915: On or about March 21, 2022 and at times prior, employees were exposed to laceration and amputation hazards due to the JET Step Pulley Drill Press (Model # JDP-20MF Stock # 354170 Serial #14097066 201409) not having a guard on the drill bit.

29 CFR 1910.252(a)(1)(ii):When the object to be welded or cut could not be moved and all the fire hazards could not be removed, guards were not used to confine the heat, sparks, and slag to protect the immovable fire hazards: a) Rusin Concrete Construction, 2475 Waynoka Rd, Colorado Springs, CO 80915: On or about March 29, 2022 and at times prior, employees were exposed to fire hazards while an employee welded an attachment on a trailer. Wood planks and wood pieces were stored on the trailer directly adjacent to the area where the employee was welding.

29 CFR 1910.134(h)(2)(i):Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or were not packed or stored to prevent deformation of the facepiece and exhalation valve: a) Rusin Concrete Construction, 2475 Waynoka Rd, Colorado Springs, CO 80915: On or about March 21, 2022 and at times prior, a half-face elastomeric respirator with particulate matter filters was not stored in a manner to protect it from contamination. The respirator was lying on the tool box in the garage directly adjacent to where welding activities were taking place.
