29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a) On or about March 21, 2022, the employer did not develop and implement an adequate written hazard communication program at the workplace for employees working with hazardous chemicals such as but not limited to concentrated Peroxide Multi Surface Cleaner and Disinfectant (skin and eye irritant) and 14 Plus Antibacterial All Purpose Cleaner (corrosive/skin irritant).

29 CFR  1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  a) On or about March 21, 2022, the employer did not provide each employee training on hazardous chemicals such as but not limited to Peroxide Multi Surface Cleaner and Disinfectant (pH 4.3-5 in concentrated form) and 14 Plus Antibacterial All Purpose Cleaner (corrosive/skin irritant) in that employees were not trained on the hazards such as the recognition of the difference between chemicals (both were yellow in color) being used in the facility.   b) On or about February 28, 2022, the employer did not ensure that each employee handling hazardous chemicals such as but not limited to Peroxide Multi Surface Cleaner and Disinfectant and 14 Plus Antibacterial All Purpose Cleaner were not adequately trained to dilute the chemical from its concentrated form during the period that the dispenser system was broken to ensure employees were not exposed to burn hazards.

29 CFR  1910.1200(h)(3): Employee Training should include at least:   (iii) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used  a) On and before February 28, 2022, the employer did not train employees on the hazards associated with the broken ECOLAB dispenser in that employees were not trained that they needed to dilute the chemical such as but not limited to 14 Plus Antibacterial All Purpose Cleaner prior to use nor were employees trained to utilize personal protective equipment such as but not limited to latex gloves when using chemical at full strength.
