29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about March 22, 2022, and at times prior to and thereafter, in the COVID ward, the employer did not provide a medical evaluation to determine each employee's ability to use a N95 respirator before requiring the use. The employer required employees to wear the N95 respirators, while providing care to mental health patients, to protect against SARS-CoV-2 virus.
