29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator and whenever a different respirator facepiece (size, style, model or make) was used: On or about March 22, 2022, and at times prior to and thereafter, in the medical center and continuing care department, the employer did not provide an initial fit test to nursing and care associate employees and did not provide a fit test to all nursing and care associate employees who wore different types of N95 respirators. The employer required nursing and care associate employees to wear N95 respirators, while providing care to patients, to protect against SARS-CoV-2 virus.

29 CFR 1910.134(m)(2)(ii): Fit test records were not retained for respirator users until the next fit test was administered: (a) On or about March 22, 2022, and at times prior to and thereafter, in the medical center and continuing care department, the employer did not retain fit test records for N95 respirator users that had been conducted in the year 2020 and thereafter. The employer required nursing and care associate employees to wear N95 respirators, while providing care to patients, to protect against SARS-CoV-2 virus.
