29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about March 24, 2022, an employee was not required to wear a hard hat while working in and around an active trench, exposing the employee to struck-by hazards.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1926.651(k)(2):Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.  On or about March 24, 2022, the competent person failed to recognize the hazardous condition and remove the employee from the hazardous conditions related to excavation work.  An employee was working in an 8 foot unprotected trench.  No abatement documentation is required of this item.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  On or about March 24, 2022, an employee was exposed to trench cave-in hazards while working in a trench without utilizing a cave-in protection system.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
