29 CFR  1910.146(c)(4):When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  a) Bully Tools Inc. located at 14 Technology Way, Steubenville, OH 43952:  On and preceding March 24, 2022, the employer did not develop and implement a written permit-required confined space entry program when employees would enter permit required confined spaces.  Employees enter a Viking model MR 2456 shot blaster for maintenance purposes or clearing jams without a permit required confined space program developed thereby exposing employees to caught-in and struck-by hazards.

29 CFR  1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:   a) Bully Tools Inc. located at 14 Technology Way, Steubenville, OH 43952:  On and preceding March 24, 2022, the employer did not conduct a periodic inspection of the energy control procedures at least annually to ensure that the procedures and the requirements of this standard were being followed. Employees were engaged in die setting and maintenance activities on machinery which included but is not limited to power presses  and a Viking shot blaster. An inspection of the hazardous energy control program had not been performed to ensure that it was being properly utilized. The following condition exposed employees to caught-in and struck-by hazards.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   a) Bully Tools Inc. located at 14 Technology Way, Steubenville, OH 43952:  On and preceding March 24, 2022, employees were exposed to machine hazards associated with moving parts during servicing, maintenance and die setting activities on machinery which included but is not limited to power presses and a Viking shot blaster. The employer failed to implement energy control application steps as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(S)(i)J, and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards. The following condition exposed employees to caught-in and struck-by hazards.

Side guards were not in place on a 105 ton Verson mechanical power press used for forming round and square shovel heads. 29 CFR  1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed:   a) Bully Tools Inc. located at 14 Technology Way, Steubenville, OH 43952:  On and preceding March 24, 2022, employees were exposed to machine hazards associated with moving parts during operation of a mechanical power press.  Guards were not in place to cover the nip points on a chain and sprocket on a 27 ton Johnson mechanical power press.  The following condition exposed employees to caught-in hazards.  b) Bully Tools Inc. located at 14 Technology Way, Steubenville, OH 43952:  On and preceding March 24, 2022, employees were exposed to machine hazards associated with moving parts during operation of a chain conveyor near the temper oven.  Guards were not in place to cover nip points on a chain conveyor used as a part of an Infrared Heating Technologies temper oven. The following condition exposed employees to caught-in hazards.
