29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On or about March 25, 2022, the employer had not implemented elements of a written respiratory protection program, to include fit testing and medical evaluations, for employees required to wear N95 respirators, exposing these employees to the hazards of an increased physiological burden, aggravation of a cardiac or pulmonary disorder, and contracting COVID-19.

29 CFR  1904.41(a)(2): Annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form.  On or about March 25, 2022, the employer failed to electronically submit injury and illness data for calendar year 2021 from their OSHA Form 300A or equivalent form by March 2, 2022. The establishment employed  52 employees in CY2021 and is classified as 623312- Assisted Living Facilities for the Elderly.
