29 CFR  1910.95(b)(1):When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls were not utilized:  On or about March 31, 2022, and at times prior thereto, employees working in the notching area where administrative or engineering controls were not utilized had noise exposure in excess of 90dBA for an 8 hour time weighted average (TW). Employees were exposed to the hazard of hearing loss from the excess sound level.

29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  29 CFR 1910.95(c)(1):  An effective hearing conservation program was not administered, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average (TWA) sound level of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.  The program shall address and complete the elements described in paragraphs (c) through (o) of this section including, but not limited to, the following:  a)  Administer a hearing conservation program;  b)  Develop and implement a noise monitoring program for employee exposures that may equal or exceed an 8-hour TWA of 85 decibels;  c)  Notify each employee exposed at or above an 8-hour TWA of 85 decibels of the results of monitoring;  d)  Establish a valid baseline audiogram and perform annual audiometric testing of employees exposed at or above an 8-hour TWA of 85 decibels;  e)  Provide hearing protection and institute a training program for all employees who are exposed to noise at or above an 8-hour TWA of 85 decibels.  The training shall be repeated annually.  The training shall include the effects of noise on hearing, the purpose, selection, fitting, use and care of hearing protection, and the purpose and method of audiometric testing.	  In the notching area, bandsaw area, pallet building machine area. On March 31, 2022, and at times prior thereto, the facility had a work area exposing employees to noise levels above 85 decibels.  The employer had not implemented a hearing conservation program as described above for employees in the facility. Three employees monitored were exposed to noise dose of 82% or an equivalent 8-hour TWA of 88.6 decibels, 136% or an equivalent 8-hour TWA of 92.2 decibels, and 173% or an equivalent 8-hour TWA of 94 decibels.

29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about March 24, 2022, and at times prior thereto, an energy control program was not developed, documented, and utilized with specific energy control procedures, periodic audits, lockout devices, and provide training on the energy control procedure to ensure that all required elements of the procedure were understood by employees and that the knowledge and skills required for the safe application, usage and removal of the energy controls were acquired by employees performing servicing such as but not limited to : cleaning of machines, changing saw blades, adjustment of machines, changing notching blades on a machine or equipment; such as but not limited to notching machines, pallet nailing machines, band saws. Employees were exposed to caught-in and struck-by hazards from the release of stored energy.
