29 CFR 1926.1053(b)(13):The top or top step of a stepladder was used as a step: a) New residential construction located on (Lot #56) 235 Anglin Walk, Alpharetta, GA 30009, Rear deck: On or about 03/28/2022, the employer exposed employees to falls of between 5-feet, 10-inches to 17-feet to the lower ground level, in that employees were allowed to work from the top step and cap of the step ladders while engaged in framing activities including the framing of the rear lower roof header. b) New residential construction located on (Lot #55) 234 Anglin Walk, Alpharetta, GA 30009, Front porch: On or about 03/28/2022, the employer exposed employees to falls of up to 3-feet, 10-inches to the lower ground level, in that employees used a step ladder in the closed position and allowed employees to use the top step and cap to access the upper level. The ladder was not used as intended creating an additional fall hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction located on (Lot #55) 234 Anglin Walk, Alpharetta, GA 30009, Front porch roof: On or about 03/28/2022, the employer exposed employees to falls of approximately 16-feet, 3-inches to the lower level, in that a fall protection system was not provided to employees engaged in framing activities on a 2/12 pitched roof. b) New residential construction located on (Lot #56) 235 Anglin Walk, Alpharetta, GA 30009, Rear deck: On or about 03/28/2022, the employer exposed employees to falls of approximately 11-feet, 7-inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities on the rear deck. ACH Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1404534, citation number 1, item number 1 and was affirmed as a final order on 07/01/2019, with respect to a workplace located at Rolling Hills Place Lot #75 Canton, GA 30115.
