29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. a. Located at 7547 Mill Springs Drive in Dublin, Ohio: On or about March 28, 2022, an employee was working from the oriented strand board (OSB) sheathing stacked on the forks of a rough terrain forklift hoisted to the second story elevation. The employee was not protected from an approximately twelve-foot fall hazard while working from the makeshift platform.

29 CFR 1926.602(c)(1)(ii):No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced. a. Located at 7547 Mill Springs Drive in Dublin, Ohio: On or about March 28, 2022, an employee was working from the oriented strand board (OSB) sheathing stacked on the forks of a GEHL DL6H rough terrain forklift in order to install sheathing to the exterior wall. The makeshift platform was not approved by the equipment manufacturer to hoist personnel.

Located at 7547 Mill Springs Drive in Dublin, Ohio: On or about March 28, 2022, the employer did not instruct and train employees working onsite on the recognition and avoidance of hazards associated with the use of fall protection and safe use of a rough terrain forklift. Angel Daniel Andrade Cardona was previously cited for a repeat violation of this Occupational Safety and Health standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1531508, citation number 1, item number 2 and was affirmed as a final order on 06/22/2021, with respect to a workplace located at 10326 Tipperary Drive, Lot 16, Plain City, Ohio. Angel Daniel Andrade Cardona was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.21(b)(2), which was contained in OSHA inspection number 1505595, citation number 1, item number 1 and was affirmed as a final order on 02/16/2021, with respect to a workplace located at 4172 Holstein Drive, Lot 188, Columbus, Ohio.
