29 CFR 1910.23(e)(3)(ii):The employer must ensure mobile ladder stand platforms with a platform height of 4 to 10 feet (1.2 m to 3 m) have, in the platform area, handrails with a vertical height of at least 36 inches (91 cm) and midrails; On or about March 28, 2022 at a facility located at 1731 Industrial Pkwy North, Marinette, WI 54143; the employer did not ensure the hand rails in the platform area of a mobile ladder stand had a vertical height of at least 36 inches when Electrical Chemical Machine employees used the platform to access the top of a press. The mobile ladder stand platform was approximately four feet two inches in height. The top rails at the platform area measured 30 inches (top rail farthest from the press), seven inches (top rail forward of the platform), and 12 to 13 inches (top rail closest to the press).

29 CFR 1910.212(a)(1):One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc. On or about March 28, 2022 at a facility located at 1731 Industrial Pkwy North, Marinette, WI 54143; the employer did not provide one or more methods of machine guarding to protect employees from machine hazards associated with moving and rotating parts a) Cell 8 Camturner Lathe machine (Model ODI-LG, S/N 1934) was not provided with machine guarding to protect the employees from the rotating chuck, flying metal chips, entanglement and caught-between hazards presented by the rotating parts of the machine's spindle, chuck and work piece, and by the clamping mechanism of the tail stock, respectively. b) Cell 4 Camturner Lathe machine (Model OP-100, S/N 321) was not provided with machine guarding to protect the employees from the rotating chuck, flying metal chips, entanglement and caught-between hazards presented by the rotating parts of the machine's spindle, chuck and work piece, and by the clamping mechanism of the tail stock, respectively. c) Cell 4 Fine bore machine (Model OP-150 S/N 510) was not provided with machine guarding to protect the employees from the rotating chuck, entanglement and caught between hazards of the rotating parts of the machine's spindle and boring tool, and by the clamping mechanism of the tail stock.
