OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to: crushing and struck-by hazards while working beneath or adjacent to automotive lifts that were not properly inspected or maintained: (a) 5300 S. Broadway, Englewood CO 80113: On or about March 29, 2022, and times prior, the employer, Summit Automotive LLC dba: Groove Subaru, exposed employees to crushing hazards while working around the Challenger, Two Post Surface Mounted Lifts, in that the vehicle lift extension arms do not simultaneously lift or lower the vehicles in express bays 1 & 2. (b) 5300 S. Broadway, Englewood CO 80113: On or about March 29, 2022, and times prior, the employer, Summit Automotive LLC dba: Groove Subaru, exposed employees to struck-by hazards while working around the Challenger, Two Post Surface Mounted Lifts, in that the synchronizing cables in express bay 1 were loose and not tightened to ensure that the tension was equal in both cables. Abatement Note: One feasible and acceptable method to correct this hazardous condition would be to follow the requirements of the Standard for Automotive Lifts - Safety Requirements for Operation, Inspection and Maintenance (ANSI/ALI ALOIM: 2020).

29 CFR 1910.22(a)(3): The employer did not ensure that walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice. (a) 5300 S. Broadway, Englewood CO 80113: On or about March 29, 2022, and at times prior, the employer, Summit Automotive, LLC dba Groove Subaru, did not ensure the floors in service bays were clean, free of hazards and kept in dry condition thus exposing employees to slip, trip or fall hazards as follows: 1) Bays 1-3: Air hoses were found on the floor and in the way of employees conducting work. Air hose reels were not installed to ensure each air hose would be secured and stored properly. Oil and water were also observed on the floor exposing employees to slip, trip and fall hazards. 2) Bays 11-14: A loose and protruding drain grate was found to be bent and protruding from its fixed position exposing all employees in the service area to slip, trip or fall hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
