29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) LSS of Marycrest, LLC, 2850 Columbine Rd., Denver, CO 80221: On or about March 29, 2022 the employer did not ensure that all employees who were required to wear tight-fitting respirators while conducting normal job operations were medically evaluated prior to use of the respirator.  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.

This exposed employees to respiratory hazards.

If the employee is out for an extended period of time, you must enter an estimate of the days that the employee will be away, and update the day count when the actual number of days is known:   (a) LSS of Marycrest, LLC, 2850 Columbine Rd., Denver, CO 80221: On or about March 29, 2022 the employer did not record six incidences of COVID-19 illness contracted while at work, which resulted in days away from work. The incidences were not recorded with a check mark in the space for cases involving days away from work and an entry of the number of calendar days away from work each employee was away from work due to the illness.

29 CFR  1904.29(b)(3):Each recordable injury or illness was not entered on the OSHA 300 Log and on an incident report (OSHA Form 301or equivalent) within seven (7) calendar days of receiving information that a recordable injury or illness had occurred:   a) LSS of Marycrest, LLC, 2850 Columbine Rd., Denver, CO 80221: On or about March 29, 2022 the employer failed to enter work related illnesses on the OSHA 300 log within 7 days of the recordable incidences.  Six employees contracted COVID-19 as a result of workplace exposure through January and February, 2022, which were not entered on the OSHA 300 log for the site.
